1. Scope
The responsAbility Investment group of companies (hereinafter also responsAbility) has issued below Privacy Statement for its recruiting process in the light of the enactment of the EU General Data Protection Regulation (GDPR), the new data protection and privacy regulation of the European Union (EU), and the upcoming revision of the Swiss Data Protection Act. When applying for a job opening by responsAbility Investments AG or one of its subsidiaries, these Privacy Statement provisions will apply to the processing of your personal data in addition to other Privacy Notice and Transparency Statements which are available on our Website or have been provided to you separately.

2. Data Protection Information
With the following information, you receive an overview of how we will process your data and of your rights in connection with data privacy laws. All responsAbility companies handle personal data responsibly, with strict confidence, in accordance with applicable laws, and according to the statements below.

3. Who Is Responsible for Data Processing and How Can I Contact Them?

4. What Sources and Data Do We Use?
4.1. We collect and process some or all of the following types of information from you:
  • Information that is provided by you when applying for a position. This includes information by using this online application system, and information received via email, in person e.g. in interviews and/or by any other method.
  • In particular, we process personal details such as title, name, first name, telephone number and email address. We further process all personal information as well as information relating to your employment history, skills and experience that you provide to us via your CV, cover letter and other accompanying documents.
  • If you contact us via email or if other information exchange happens by that medium, we maykeep a record of that correspondence.
  • Details of all actions that you carry out through the use of this online application system are stored.
  • Details of your visits to responsAbility’s Careers Website including, but not limited to, traffic data, location data, weblogs and other communication data and the resources that you access will be collected.
4.2. We may also process personal data that we obtain from publicly accessible sources, (e.g. debt registers, commercial and association registers, press, internet incl. World Check) or that is transferred between responsAbility group companies (this includes companies outside Switzerland and the EEA) or received from third parties like executive search agencies).
4.3. In particular, we may also link the data you provide, with other publicly available information about you that has been published on the internet. This may include sources such as LinkedIn and other social media profiles.
4.4. We may obtain your personal data from public databases which we use to find possible candidates to fill our job openings.

5. Purposes of Processing and Legal Basis
5.1. Information about you is used as follows:
  • To consider your application in connection with a role for which you have applied.
  • To consider your application in connection with other roles your professional background could be a fit.
  • To communicate with you in connection with the recruitment process.
  • To improve and/or confirm any information about you with information obtained from third party data providers.
  • To find appropriate candidates to fill our job openings.
5.2. The processing of your data is necessary for the fulfillment of an employment contract with us or for the performance of pre-contractual measures, since without this we cannot conclude the contract or take precontractual measures.
5.3. We further rely on our legitimate interest as the lawful basis on which we collect and use your personal data. Our legitimate interests are the recruitment of staff for our business.

6. Obligation to participate in the collection of Personal Data
6.1. The provision of your personal data is required for the implementation of pre-contractual actions and any subsequent conclusion of the employment contract. A non-provision would mean that the implementation of pre-contractual actions and a possible conclusion of the employment contract are not possible.

7. Who Receives My Data?
7.1. Within responsAbility, every unit that requires your data to pursue the purposes of the processing will have access to it. Service providers and vicarious agents appointed by us can also be given access to data for the purposes given, if they maintain confidentiality. These are companies in the categories of IT services, telecommunications, advice and consulting.
7.2. We rely on services of and your data will be stored and processed on our behalf in the systems of our software partner Haufe-umantis AG. Haufe-umantis AG is only entitled to process your personal data in accordance with our instructions.

8. Will Data Be Transferred to a Third Country or an International Organization?
8.1. Your data may be shared with responsAbility group companies and/or specialized IT service providers. As such, your data may be transferred to countries outside Switzerland or the European Economic Area (EEA). Personal data is transferred outside the EEA on the basis of declarations of adequacy or other appropriate safeguards, in particular standard data protection clauses adopted by the European Commission.
8.2. Please contact us if you would like to request to see a copy of the specific safeguards applied to the export of your information (Article 13 para 1f of the GDPR).

9. Security of Processing
9.1. Taking into account the state of the art, the costs of implementation and the nature, scope, context and purposes of processing as well as the risk of varying likelihood and severity for the rights and freedoms of natural persons, we make reasonable efforts to protect personal data against accidental and illegal destruction and loss. We strive to ensure that personal data is used properly and protected from unauthorized access, use or disclosure. We use a combination of process, technology and physical security controls to protect personal data from unauthorized access, use or disclosure.
9.2. In addition, access to personal data is restricted to employees, contractors, and agents who need such information to perform their assigned functions and/or to develop or improve our services.

10. For How Long Will My Data Be Stored?
10.1. At the end of the application process or when you withdraw your application, your data will be deleted within 12 months in accordance with applicable law, unless we ask you individually for longer time periods in order to consider you for other roles. In such an event, your data will continuously be stored for another 12 months after your last interaction with us will have taken place or until you ask us to delete your data from our files.
10.2. If you have not been active in your applicant account for a period of 12 months (e.g. CV update, new job application), your profile will be irrevocably anonymized, and you would have to submit a new application, if you like to be considered for new positions.

11. What Data Privacy Rights Do I Have?
11.1. Within the scope of the data protection laws applicable to you and insofar as provided therein you have the right to access according to Article 15 GDPR (Article 8 FADP), the right to rectification according to Article 16 GDPR (Article 5 FADP), the right to erasure according to Article 17 GDPR (Article 5 FADP), the right to restrict processing according to Article 18 GDPR (Articles 12, 13, 15 FADP), the right of object according to Article 21 GDPR (Article 4 FADP), and if applicable – the right to data portability according to Article 20 GDPR. Furthermore, if applicable to you, there is also a right to lodge a complaint with an appropriate data privacy regulatory authority (Article 77 GDPR).
11.2. You can withdraw consent granted to us for the processing of personal data at any time. Please refer to the above.

12. Right to lodge a complaint with a Supervisory Authority (Article 13 para 2 d, 77 para 1 GDPR)
12.1. As the controller, we are obliged to provide a notice of the right to lodge a complaint with a supervisory authority, Article 13 para 2 d of the GDPR. The right to lodge a complaint with a supervisory authority is regulated by Article 77 para 1 of the GDPR. According to this provision, without prejudice to any other administrative or judicial remedy, every data subject shall have the right to lodge a complaint with a supervisory authority, in particular in the EU Member State of his or her habitual residence, place of work or place of the alleged infringement if the data subject considers that the processing of personal data relating to him or her infringes the GDPR. The right to lodge a complaint with a supervisory authority was only limited by the law of the Union in such way, that it can only be exercised before a single supervisory authority (Recital 141 Sentence 1 GDPR). This rule is intended to avoid double complaints of the same data subject in the same matter. If a data subject wants to lodge a complaint about us, we therefore ask to contact only a single supervisory authority.
12.2. This arrangement is intended to avoid double complaints in the same case by the same data subject. Therefore, if an affected person wants to complain about us, we ask you to contact only one regulatory body.

13. To What Extent Is There Automated Decision-Making or Profiling?
13.1. We generally do not use any automated decision-making nor any Profiling pursuant to Article 22 GDPR. If we use this procedure in individual cases, we will inform you of this separately, provided that this is required by applicable law.
13.2. We may use certain technology of our IT providers to select appropriate candidates based on criteria we have identified. However, any decision as to who we will engage to fill the job opening will be made by our staff.
